Regular Meeting

D. Schreiber called the meeting to order at 7:34.

New Business

W2013-11 Application to create one building lot to construct a house at 55 Blair Road (Map 53 Lot 3 Zone R80) (no jurisdiction) Owner/Application: Stephen G. Lackman (Received May 13, 2013 Decision by June 10, 2013 Decision within 35 days after close of P.H.)

Application was received May 13, 2013.  Mark Peterson of Gardner & Peterson Associates was present for the applicant.  He said they are asking for No Jurisdiction and proposing to cut off one building lot, less than 2 acres, on a 90 acre parcel.  Mr. Peterson said the wetlands have been delineated by John Iani and no wetlands are on the proposed parcel or within 500 feet of the proposed parcel.  He said they have done soil testing and received approval from Eastern Highland Health Department.  The Commission looked at the proposed plans.

The Commission remanded application W2013-11 to Staff.

W2013-12 Application for tree removal, and site work to construct a new septic system with a septic tank, pump station and force main will be installed at 380 Daleville Road (Map 02 Lot 01 Zone R80) Owner/Applicant: RRE VIP Willington, LLC (Received May 13, 2013 Decision by June 10, 2013 Decision within 35 days after close of P.H.)

Application was received May 13, 2013.  S. Yorgensen said the septic repair is badly needed and she has reviewed the file.  She said nothing is in a wetland or watercourse and the applicant has been working with DEEP on the septic design.  S. Yorgensen said she has also reviewed the erosion control plan.  A discussion was held on the application.

The Commission remanded application W2013-12 to Staff.
W2013-16 Application to add one bay to existing garage in regulated area at 59 Jared Sparks Road (Map 28 Lot 31-2 Zone R80) Owner/Applicant: Mark Drobney (Received

Application was received May 13, 2013.  Mark Drobney recused himself.

S. Yorgensen said the location is in an already disturbed area and does not affect the wetlands.  The Commission looked at the plans and a discussion was held on the distance from the wetlands.  D. Schreiber said it appears to be 80 or 90 feet from the wetlands and the proposed locations is in an upland review area.  

The Commission remanded application W2013-16 to Staff.  T. Gutowski would like additional information on the wetland distances submitted as part of the application.

Old Business

W2013-5 Modification of wetland permit W2012-42 to change location of septic leaching area and detention basin at 333 River Road (Map 30 Lot 17 portion) Owner: B & M Realty, LLC Applicant: Dekk Group, LLC (Received March 11, 2013 Public Hearing by May 13, 2013 decision within 35 days after close of P.H.)

Dave Held of Provost & Rovero was present for the applicant.

S. Yorgensen read the letter from Jacobson & Associates dated March 11, 2013 and based on the Town Engineers comments, the applicant made changes to the plan and relocated the septic which moves the activity further away from the wetlands.

The Commission looked at the plans and a brief discussion was held.  

T. Gutowski motioned to approve application W2013-5 , revised plans dated March 5, 2013, with the standard conditions. M. Drobney seconded the motion.  A discussion was held on the standard conditions attached to the wetland permit.    A vote was held and unanimously approved.  

W2013-7 Application to construct grass storm water biofilter and portion of processed aggregate driveway and parking area in regulated review area at 40 Cisar Road (Map 8 Lot 3A Zone R80) Owner: Lao Lane Xang Temple of Connecticut Applicant: David Lebel (Received March 11, 2013 Public Hearing by May 13, 2013 decision within 35 days after close of P.H)

David Lebel, the applicant, and Peter Henry, a Professional Engineer, were present.  Mr. Henry presented plans dated 1/10/2013 and last revised 4/24/2013.  D. Schreiber read the letter from Town Engineer, Jacobson & Associates dated May 9, 2013 which stated they have reviewed the plans last revised 4/24/2013 and the applicant has adequately addressed the comments noted in their April 5, 2013.

T. Gutowski said she conducted a site walk and her only concern was the area in the corner; she is concerned that the water could sheet toward the pond.  Mr. Henry said the grass storm water biofilter was extended, per request of the Town Engineer, for this reason.  He said they also asked for spot grades at the corner of the parking lot and in the front lot.  A discussion was held.    

Mr. Henry said they may possibly propose a shed in the future but would come back at that time.  He said they eliminated the parking space closest to the wetlands which reduced the amount to 34 spots.  A discussion was held on the location of the driveway.  T. Gutowski asked if the applicant had discussed moving the driveway due to the bedrock in the area and Mr. Henry said they did discuss it with the Town Engineer and the location proposed was best suited and the bedrock will come out with a machine.  

T. Gutowski questioned snow removal.  Mr. Henry showed the location they would pile the snow and a discussion was held on treating icy surfaces.  Mr. Henry said they would probably use sand but there are now many different products available.  T. Gutowski said she is concerned about products that could potentially contaminate wells on adjacent properties.  

T. Gutowski motioned to approve application W2013-7 with the following conditions:

  • All Standard Wetland Conditions
  • An Engineer to be onsite when the biofilter is constructed and included on the site as built
Snow storage area to be depicted on map
  • De-icing products to be used shall be identified and will not include sodium chloride.
M. Drobney seconded the motion.  All in favor.  Motion carried.

Old Business

W2003-49 Notice of violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

This application was tabled.

Staff Report and Discussion

A discussion was held on stating that standard wetland conditions are part of the approval motion.

Set date for site walk on Hockla Farms Road

The site walk was scheduled for Sunday, May 19, 2013 at 8:00 am.  S. Yorgensen will notify Karl Acimovic.
